Legislation for Smoke Control Area Authorised Fuels Consolidated in Northern Ireland

These Regulations consolidate the Smoke Control Areas (Authorised Fuels) Regulations (Northern Ireland) 2008 and the Smoke Control Areas (Authorised Fuels) (Amendment) Regulations (Northern Ireland) 2010. They also add four additional authorised fuels and provide that stocks of authorised fuels manufactured before these Regulations came into operation remain as authorised fuels.

Nitrates Action Programme Changes in Northern Ireland

These regulations make amendments to the Nitrates Action Programme in Northern Ireland to allow for the storage of poultry litter up to a maximum of 180 days in the field where land application will take place until 31 March 2012.

PPC Changes for Scotland

New legislation: The Control of Volatile Organic Compounds (Petrol Vapour Recovery) (Scotland) Regulations 2011

These Regulations amend the Pollution Prevention and Control (Scotland) Regulations 2000 to require PVR II (petrol vapour recovery – Stage II) controls for certain service stations to control VOC emissions from vehicle refuelling.

PVR II controls are now required for:
• new service stations below permanent living quarters or working areas with throughput above 100m3 from 1 January 2012;
• existing service stations undergoing a major refurbishment with an actual or intended throughput at the time of refurbishment of above 500m3 (or 100m3 if below permanent living quarters/working areas) from 1 January 2012; and
• existing service stations with an annual petrol throughput of 3,000m3 a year by 31 January 2018.

The Regulations also make amendments to the Environmental Protection (Prescribed Processes and Substances) Regulations 1991 and the Environmental Protection (Applications, Appeals and Registers) Regulations 1996, and revoke the Environmental Protection (Prescribed Processes and Substances Etc.) (Amendment) (Petrol Vapour Recovery) Regulations 1996.

Consents for Operations on SSSIs Streamlined in Scotland

New legislation: The Nature Conservation (Scotland) Act 2004 (Authorised Operations) Order 2011

When does this change take place: 13th January 2012

This Order describes the types of operations undertaken which affect a site of special scientific interest (SSSI) but which do not require the consent of Scottish Natural Heritage under sections 13 (operations by public bodies etc.) and 16 (operations by owners or occupiers of sites of special scientific interest) of the Nature Conservation (Scotland) Act 2004.

Scottish Government Enacts Powers to Transpose Industrial Emissions Directive

New legislation: The Pollution Prevention and Control (Designation of Industrial Emissions Directive) (Scotland) Order 2011

When does this change take place: 1st January 2012

This Order designates the Industrial Emissions Directive (European Directive 2010/75/EU on industrial emissions (integrated pollution prevention and control) (Recast)) as a relevant directive for the purposes of paragraph 20 of Schedule 1 to the Pollution Prevention and Control Act 1999. This allows the Scottish Government to transpose the Directive into Scottish Law.

The Industrial Emissions Directive will replace the current directives on pollution prevention, combustion plants, waste incineration, titanium dioxide and solvent emissions with a single recast directive.

Additional Requirements for Ecodesign

New legislation: The Ecodesign for Energy-Related Products (Amendment) Regulations 2011
Who does this affect: UK – Manufacturers of Energy-Related Products
When does this change take place: 1st December 2011

These Regulations amend the Energy Information Regulations 2011 to require that technical documentation is available as soon as a product is placed on the market or put into service and for at least five years after the last date of manufacture.

They also amend the Ecodesign for Energy-Related Products Regulations 2010 to insert two additional products – household dishwashers and household washing machines.

Latest Consultation - Environmental Permitting

Defra is consulting on the level of fees and charges levied under the Environmental Permitting Regulations 2010 for the Local Air Pollution Prevention and Control (LAPPC) and Local Air-Integrated Pollution Prevention and Control (LA-IPPC) permits.

These fees and charges in England are applied to around 19,000 or so businesses who hold LAPPC and LA-IPPC permits, including chipboard and glass manufacturers, foundries, animal renderers, crematoria, paint manufacturers, larger furniture works, petrol stations and high street dry cleaners, and to their local authority regulators.

The Welsh Assembly Government is consulting separately on these charges. Its consultation closes on 23 January 2012. Further information is available on the links below.

Latest Consultations - Charges and Fees

The Environment Agency is asking for comments on proposed changes to its charging schemes from April 2012 to end of March 2015.
The agency is suggesting no change for the majority of charge-payers for two years, with a check at the end of the first year (2013) to ensure this is sustainable.
It is also planning a small number of technical changes and a small increase in charges in year three. The freeze on charges in the first two years does not include abstraction charges.
The EA is proposing to increase these charges each year to ease specific costs pressures.
